Terms of Use
Effective October 25, 2026 · Last updated October 25, 2026
These Terms of Use apply to this website and its articles, downloads and interactive tools. Please read them before using the site. If you do not agree, do not use the site. Any enforceability of these terms is subject to applicable law.
Website information and engagement services
The website provides general information about financial, operational and strategic business topics. It does not take your particular circumstances into account. Visiting the site, downloading a publication, sending an inquiry or booking an introductory meeting does not by itself establish a client, fiduciary or advisory relationship. Services, fees, responsibilities and confidentiality obligations are established in a separate written engagement agreement. That agreement controls if it conflicts with these website terms on client services.
Professional advice and independent decisions
Public content is not individualized legal, tax, accounting or securities investment advice, an audit or assurance opinion, or an offer to buy or sell a security. Obtain appropriate advice based on your circumstances before acting. You remain responsible for assessing assumptions and making business decisions. Read our Disclosures for further context.
Ownership and reserved rights
As between Orca and website users, Orca retains the rights it owns in its original articles, white papers, illustrations, charts, templates, diagnostic materials, model documentation, software code, and the original selection and arrangement of website materials. Other material remains the property of its respective owner or licensor. Rights are reserved only to the extent they exist under applicable law; no ownership is claimed over third-party content, client-owned data, public-domain material, general business knowledge, facts, or independently developed work.
Limited permission to use published materials
You may read and download publicly offered materials and circulate unaltered copies within your organization for informational purposes, preserving source links, attribution, copyright notices and disclosures. You may link to Orca publications and make limited quotations as permitted by law. This permission does not transfer ownership or authorize resale, sublicensing, external republication, white-labeling, or incorporation of protected Orca materials into commercial training, software, consulting products or services. Obtain written permission for uses beyond this permission, unless otherwise allowed by law. Specific license terms accompanying a resource or a signed agreement take precedence.
Methods, tools and confidential know-how
Publication of an overview does not grant access to unpublished implementation materials, model source files, diagnostic scoring logic, internal playbooks or other nonpublic know-how. Copyright protects qualifying expression, not the underlying idea, method, formula, system or process itself. Any additional contractual restrictions on access or use, and any confidentiality obligations, must arise under an applicable agreement. Public information is not made confidential merely by this notice.
Client deliverables and pre-existing materials
Ownership and permitted use of client deliverables, client data, pre-existing Orca materials, reusable tools and engagement-specific developments are determined by the signed engagement agreement. These website terms do not assign client rights to Orca or change an existing agreement. Prospective clients should agree deliverable licenses and any transfer of rights in writing before work begins.
Brand and third-party rights
No permission to use Orca’s name, logo or other brand identifiers as your own, or to imply sponsorship or endorsement, is granted. This does not restrict lawful descriptive references. Third-party names, logos, research and other materials remain subject to their owners’ rights. References and source attribution do not transfer those rights to Orca or website users.
Automated reuse and permissions
The permission above does not authorize bulk republication, commercial content extraction, dataset creation, or AI model training using protected Orca materials. Seek written permission for those uses where authorization is required by applicable law. These terms do not override statutory exceptions or establish a technical barrier to copying. Send licensing requests or reports of suspected unauthorized use to support@orcaoperatingpartners.com, identifying the material, its original URL and the proposed or disputed use.
Express written approval for business use
Except for the limited internal informational use expressly permitted in these Terms, or uses independently permitted by applicable law, companies and other organizations must obtain Orca Operating Partners’ express prior written approval before using, reproducing, adapting, distributing, republishing, licensing, selling, white-labeling or incorporating Orca-owned marketing materials, branding, logos, content or protected proprietary process materials into their own marketing, products, services, training or client work. This includes protected playbooks, templates, model documentation and other proprietary implementation materials. Public availability, downloading, attribution, prior discussions or silence do not constitute approval for these uses. Approval must expressly identify the authorized materials, purpose and scope and must come from an authorized Orca representative; a signed license or engagement agreement may provide that approval. Requests should be sent to support@orcaoperatingpartners.com.
This clause applies only to rights Orca owns or is authorized to license. It does not claim exclusive ownership of general ideas, facts, business methods or independently developed processes, override statutory exceptions, or change rights already granted under a signed agreement. Restrictions on confidential know-how and underlying processes require an applicable confidentiality, license or engagement agreement.
Acceptable use
Do not misuse the website, attempt unauthorized access, interfere with its security or availability, introduce malicious code, impersonate others, or infringe privacy or intellectual property rights. Automated access must respect applicable law, access controls and reasonable service limits. Do not submit materials you are not authorized to share.
Examples, tools and availability
Calculators, forecasts and financial scenarios are illustrative and depend on their stated assumptions. Outputs may omit relevant costs, taxes, timing, risks or circumstances. They are not valuations, commitments, forecasts or guarantees of actual results. Content may become outdated, and the website may contain errors or interruptions. We may update or discontinue content or tools.
External services
Links, scheduling tools and subscription embeds may take you to services operated by others. Their own terms and privacy policies apply. A link or reference does not by itself constitute endorsement, and we do not control external content or service availability.
Website warranties and liability
To the extent permitted by applicable law, website content and tools are provided “as is” and “as available,” without warranties of completeness, accuracy, fitness for a particular purpose or uninterrupted availability. To that same extent, Orca is not liable for indirect or consequential loss arising from use of or inability to use the website or reliance on its general information. These provisions do not exclude liability or rights that cannot lawfully be excluded, and do not alter obligations under a signed client agreement.
Privacy, updates and contact
Our Privacy Policy explains how information is handled. Updated terms will be posted on this page with a revised date; changes do not retroactively amend a signed client agreement. For questions or permission requests, email support@orcaoperatingpartners.com. To discuss an engagement, schedule a conversation.
